Castledermot man has conviction overturned

A MAN who who received a six-month prison sentence for dangerous driving back in April had the charge struck out on appeal recently.

Conor Quinn (25) of Davidstown, Castledermot was acquitted of dangerous driving on appeal at a sitting of the circuit court in Athy on Friday 25 July. In April, Judge Desmond Zaidan had found Mr Quinn guilty of the offence at Crookstown Road, Athy on 10 August 2023. Along with a prison sentence, Mr Quinn received a four-year driving ban and €4,000 fine. 

It had been alleged that Mr Quinn undertook a learner motorcyclist on the day in question.

Mr Quinn’s solicitor at the time pointed out that none of the witnesses could place him at the wheel, and that vehicle, covered by fleed insurance, could had been driven by a number of other individuals. Mr Quinn lodged an appeal which was subsequently heard on 25 July, and it was here that Judge Elva Duffy struck out charges on direction by the defence.

“Nobody was available to give evidence that Conor was driving,” said solicitor John O’Gorman who came on board for the appeal along with barrister Martin Dully.

“All the charges were struck out.”
