A MAN who headbutted a garda in a garda station had his sentencing put back for two months so his solicitor could formalise a medical report for his defence.

“You assault a guard you may as well assault a judge or a prison officer,” Judge Desmond Zaidan warned Andre Kruger (46) from Ashley House Apartments, Tully East, Kildare.

Mr Kruger was in Athy District Court last week (23 September) with his solicitor Joe Coonan to seek one further adjournment in order to prepare a report.

He had originally been apprehended for being intoxicated at Noonan’s Service Station in Carlow over three years ago on 11 September 2022.

Therein followed a raft of other charges, including wilful obstruction of a garda, no insurance, no licence and failure to produce.

Following his arrest, he was subsequently taken to Naas Garda Station where he assaulted Garda John Lynch who, fortunately, suffered no lasting injuries.

“He headbutted a guard? In the station?” asked Judge Desmond Zaidan.

“Unless there are exceptional circumstances, whether today or in six months’ time, the risk (of a jail sentence) won’t change,” warned the judge.

“It was borderline indictable,” conceded Mr Coonan, indicating he knew how fortunate his client was that the DPP had ruled the case be heard in a district court.

On that the judge put the case back one final time to 11 November for sentencing.
