A man who started filming gardaí, before roaring at them: “go on, ye baldy c*nts!”, was able to leave court without a conviction after a visiting judge showed sympathy with the defendant’s circumstances.

Appearing before the last January sitting of Naas District Court was Shane Kelly (19), Morristown Crescent, Newbridge.

Approached Gardaí

He appeared for sentencing on a public order charge from 6 July, 2023 when he was still a month from his majority.

On that day gardaí were parked at Cornelscourt in the town “when Shane Kelly approached the guards, started videoing and shouting, saying: “go on, ye baldy cu*ts!”

“The garda is sporting a good head of hair, he’s not follicly challenged!” joked defending solicitor Tim Kennelly.

“Judge, my client had been remanded in custody for the Circuit Court over Christmas, and it’s been hell on earth for him away from his family,” he added. No further details about this were given to the court.

“He’s been in custody since December,” he said.

Angry, not drunk

“Have you finished school?” asked Judge John Brennan.

“No, just the Junior Cert,” said the defendant.

“My ma passed away from cancer,” he added.

“He’s a groundworker with his father,” said Mr Kennelly.

“State of mind (at the time)?” asked Judge Brennan.

“He was angry, not drunk,” said Sergeant Dave Hanrahan. “Nothing sinister”.

Hearing that, the judge game him the benefit of the Probation Act on this one charge.
