A MAN who allegedly assaulted his aunt and broke a window at her home will be sent forward to appear in the circuit court after a judge refused jurisdiction in Naas District Court recently.

Francis Lynch (21) with an address at Oakland Drive, Clonmel, Co Tipperary appeared in Naas District Court on three charges, allegedly committed at Ruanbeg Park, Kildare town on 8 April 2023.

'Closed Fist assault'

Outlining the charges, Sergeant Dave Hanrahan told the court that the DPP had recommended “summary disposal” (to be heard in the district court), although this was quickly moved up to the superior court once the judge heard the allegations.

“It is alleged he struck his aunt several times with a closed fist and kicked her," said Sgt Hanrahan.

“There were lumps on her forehead and bruising,” he continued, before adding that he is also alleged to have broken a window at the Ruanbeg address and was arrested for threatening and abusive behaviour in public.

On Bail

Hoping to keep the case in the district court, defending solicitor Tim Kennelly reminded Judge Desmond Zaidan that “my client was not remanded in custody on these (charges)”.

However, Judge Zaidan was not moved by this suggestion and promptly told Mr Kennelly he was refusing jurisdiction and remanded Mr Lynch on continuing bail until 23 October for his book of evidence.
