A WOMAN charged with having four bald tyres leading to an accident which left her seriously injured left court with the charges struck out after the judge learnt she had recently received a settlement after her employer accepted responsibility.

Marina Sirichenko (63) of Yew Tree Square in Clane appeared in Naas District Court to face four charges of having bald tyres at Healy’s Bridge, halfway between Prosperous and Kilmeague, on 15 September 2020. The defendant appeared in court with the aid of a translator and crutches.

Single-vehicle accident

Sergeant Mary Meade explained that the vehicle was seen on the wrong side of the road, before being involved in “a single-vehicle accident” in which she went off the road and ended up in the ditch.

The sergeant confirmed that all four tyres were illegally treadless and the fixed penalty notice that was issued on the day had not been paid, which had led to these charges.

“This was her employer’s van. She was told to drive the van and she’d be looked after,” said barrister James P O’Brien.

“She received significant injuries, including a broken leg, and is still on crutches.

“My client’s employer took responsibility and she received a substantial settlement in the High Court in July,” he said, and Sgt Meade confirmed.

“These are extraordinary circumstances, so I will strike out all charges,” declared Judge John Brennan.

“Wish your client well,” he offered.
