IN a moment that is rarely seen in court, a man in custody actually sought a sentence, and protested when he heard that all his charges were being struck out.
Aaron Lambe (28), with an address at Blackhall Street in Dublin 7 appeared in Naas District Court by videolink from custody, where he is serving a sentence for an unrelated crime, charged with two counts of theft from nine years ago.
The charges were for theft from Boots in Maynooth in July 2017 when he stole €507 worth of perfumes, and a set of ear buds worth €493.
“Howya, judge,” said Mr Lambe.
“Aaron Lambe?” checked Judge Desmond Zaidan.
“The one and only,” replied the defendant on screen.
“What happened to your teeth?”
“Fighting,” said Mr Lambe.
“But good news, the state is withdrawing your charges today,” he added.
“Can I not get a sentence today?” asked Mr Lambe, as laughter echoed around the courtroom.
“Why are they withdrawing it?” he continued.
“The DPP directs all prosecutions, independent of me or the guards. If they had any evidence they would use it,” explained the judge.
“So I will not be imposing your wish for a sentence, I’m not the tooth fairy,” smiled the judge, as Mr Lambe returned to serve out the rest of his sentence.
