Man who exposed genitals in Kildare supermarket receives fine

A MAN who exposed his genitals in a shop in Newbridge was fined €750, but avoided having his name put on the sexual offenders’ register for now, even without showing up in court. The man who can’t be named at this stage gave his address as no fixed abode in Newbridge and was due to appear at Naas District Court last week (5 February) for sentencing.

Sergeant Mary Meade told the court how the defendant entered the Supervalu in Newbridge Retail Park on 26 September, 2024.

“He was asked to leave, then he exposed his genitals to the store manager,” said the sergeant.

“He was caught on CCTV and made full admissions,” she said, adding that the charge was contrary to Section 45 of the Criminal Law (Sexual Offences) Act.

“The manager was trying to prevent a theft,” she added as a reason for this encounter. Sgt Meade told the court that this offence had a maximum sentence of six months and was carry a 'Class D' fine.

“His problem is alcohol, judge. He rang me this morning and he sounded very much under the influence of alcohol,” said defending solicitor Tim Kennelly in explanation of his client’s absence. Sgt Meade told the court that the man had 11 previous convictions and four post 26 September 2024.

"Will he go on the sexual offenders’ register?” Judge Desmond Zaidan asked to clarify, but Mr Kennelly and Sergeant Meade both said they wasn’t sure. 

So, in order to clear his docket the judge decided to fine the man €750 in abstentia, giving him three months to pay. 

“I won’t put him on the sex offenders’ register, but I will give the state leave to re-enter (the case) if you believe he should go on the register,” said the judge.
