AN elderly man who was drunk in the middle of the day and tripped a kid off a scooter avoided a conviction after the judge accepted his tale of personal woe.

Eamonn Corrigan (73) of William Pearse Terrace, Castledermot was appearing in Athy District Court to plead guilty to his behaviour on 27 March at Carlowgate, Castledermot.

Sergeant Dave Hanrahan explained that Corrigan was found by collegues “walking in the street at 1.40pm”.

“Drunk and misbehaving?” guessed Judge Desmond Zaidan.

“He then tripped a boy on a passing scooter,” said the sergeant.

“He was drinking on medication, and has had some issues since his divorce,” explained his solicitor Seamus Boyle.

“He’s a 73-year-old man, and this is his first time in court,” said Mr Boyle.

“Why did you trip this kid?” asked the judge.

“It was stupid behaviour by a man who should know better,” said Mr Boyle. “He lives alone after his divorce a few years ago.”

Seeing from his court papers that the boy was thankfully uninjured the judge decided to apply the Probation Act.
