Man sent forward to circuit court for assaulting garda sergeant

He was served with a book of evidence last week

A GRAIGUECULLEN man was last week served a book of evidence in Carlow District Court and will now face a charge in the circuit court of assaulting a garda sergeant, causing him harm. Colvin O’Brien, Heather Hills Mews, Graiguecullen was served a book of evidence last week by Garda Caroline O’Malley with a single charge of seriously assaulting the sergeant at John Street, Carlow on 29 August 2024.

State solicitor Brendan O’Flaherty told the court that there are other charges arising from the same incident, including Mr O’Brien assaulting a second garda as well as being intoxicated and engaging in threatening, abusive and insulting behaviour, which may be added to the book of evidence in due course.

Judge Geraldine Carthy put Mr O’Brien on an alibi warning, meaning that he has to inform the prosecution if he is to rely on an alibi, while she also granted solicitor Alex Rafter legal aid and extended it to cover a junior counsel in the circuit court.

Mr O’Brien (30) has other, unrelated charges pending against him in the district court. They include two public order offences that occurred at Haymarket, Carlow on 18 September last year and two charges of failing to appear before Carlow District Court in September and October last year.

Judge Carthy adjourned those charges and remanded Mr O’Brien on continuing bail to the district court until 2 July.
